These Terms of Service ("Terms") govern your access to and use of the boreon.com website ("Site") operated by Boreon Industries LLC ("Boreon," "we," "us," or "our"). By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms.

These Terms apply to the website only. They do not constitute a services agreement. All professional services engagements (analytics, AI, network, infrastructure, or managed services) are governed by a separate, written Statement of Work (SOW) and/or Master Services Agreement (MSA) executed between you and Boreon Industries LLC. • Submit a contact enquiry or request for a discovery call
• Access and download publicly available content (service descriptions, case studies, blog posts) for your personal, non-commercial reference
• Purchase a Tableau Cloud migration engagement at a published fixed price, subject to the checkout terms presented at time of purchase

3   Prohibited Uses

The following uses of boreon.com are strictly prohibited:

• Scraping or data mining: Systematically crawling, scraping, or harvesting content, pricing, client information, or any other data from this Site for any purpose, including building a competing product or compiling market intelligence
• Security testing without authorization: Probing, scanning, or testing the vulnerability of the Site or any associated infrastructure without express written consent from Boreon
• Automated submissions: Submitting automated or bot-generated messages through the contact form
• Impersonation: Misrepresenting your identity or affiliation when contacting Boreon through the Site
• IP infringement: Reproducing, distributing, modifying, or creating derivative works from Site content without permission
• Interference: Attempting to interfere with, disrupt, or circumvent the Site's security, functionality, or availability
• Unlawful use: Using the Site in any way that violates applicable law, regulation, or third-party rights

Boreon® is a registered trademark of Boreon Industries LLC in the United States of America. AI Church and Sermon Assistant are product names owned by Boreon Industries LLC and published under the Boreon® umbrella brand.

The Boreon® mark and the AI Church and Sermon Assistant product names may not be used in connection with any product, service, or organization without the prior written consent of Boreon Industries LLC, except for nominative fair use (accurately referring to Boreon when describing the software you are using) and attribution (accurately crediting Boreon in published content).

5   Professional Services

Information on boreon.com describing our services, capabilities, pricing, and project history is provided for informational purposes. It does not constitute an offer, guarantee, or warranty of any specific outcome.

Fixed-price Tableau migration engagements purchased through the Site checkout are subject to the scope and terms presented at time of purchase. For migrations outside those published scopes, contact us for a custom Statement of Work.

All professional services engagements are governed exclusively by the written SOW and/or MSA signed by both parties. Nothing on this website creates a professional services obligation.

6   Confidentiality & Master NDA

Every non-disclosure or confidentiality agreement you have entered, or will enter, with Boreon Industries LLC or any of its affiliates or brands (including KWAM and Sermon Assistant) governs your access to and use of all Boreon properties as a single, unified obligation.

All NDAs in effect between you and Boreon Industries LLC apply across the entire Boreon family of properties, including but not limited to:

• Boreon Industries — boreon.com
• AI Church — aichurch.boreon.com
• Sermon Assistant — sermonassistant.ch
• KWAM — kwam.ch

The Boreon Master Non-Disclosure Agreement (the "Master NDA") is the controlling and superseding confidentiality instrument across all covered properties. If you have not executed a separate written NDA with Boreon, your acceptance of these Terms and access to any covered property constitute your agreement to the confidentiality obligations described herein as though set forth in a fully executed Master NDA.

"Confidential Information" includes, without limitation: source code, architecture, algorithms, data models, unreleased features, security configurations, API keys and credentials, business and financial information, product roadmaps, pricing, and any other non-public information disclosed by Boreon in any form. Confidentiality obligations survive the termination of these Terms and continue for so long as the information remains non-public.

7   Links to Third-Party Sites

boreon.com may link to third-party websites (Infomaniak, PayPal, partner organizations). These links are provided for convenience. Boreon does not control, endorse, or accept responsibility for the content, privacy practices, or terms of any third-party site. Your use of linked sites is at your own risk.

BOREON'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO BOREON.COM SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100.00), EXCEPT AS OTHERWISE PROVIDED IN A SIGNED STATEMENT OF WORK OR MASTER SERVICES AGREEMENT.

10   Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States of America and applicable state law, without regard to conflict of law provisions. For matters involving intellectual property infringement, Boreon reserves the right to seek relief in any court of competent jurisdiction worldwide.

11   Dispute Resolution

Before initiating any formal legal proceeding, parties agree to attempt informal resolution by contacting Boreon at jharris@boreon.com with subject line DISPUTE: and a description of the issue. We will respond within 10 business days.

If informal resolution fails, disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association, conducted in English, on an individual basis only — not as a class, consolidated, or representative action. Boreon may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property without first resorting to arbitration.

12   General Provisions

Entire Agreement (Website). These Terms, together with our Privacy Policy, constitute the entire agreement between you and Boreon with respect to your use of boreon.com as a website visitor. They are superseded entirely by any signed SOW or MSA for professional services.

Severability. If any provision of these Terms is found unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue in full force.

No Waiver. Boreon's failure to enforce any right or provision shall not be deemed a waiver.

Changes. We may modify these Terms at any time. Continued use of boreon.com after changes become effective constitutes acceptance. We will update the "Last Updated" date above when changes are made.
